Casino Age by State: The Legal Gambling Age in All 50 States

A blank ID card beside a brass service bell, with two stacks of red and black casino chips on a green felt casino table

The casino age by state is 21 in most of the country, but not all of it. 26 states set 21 for their state-licensed casinos, 7 let you play somewhere at 18, and tribal casinos run from 18 to 21 depending on the compact. Online casinos are 21 in all 7 legal states, and lottery tickets are 18 in 40.

  • Is the gambling age 18 or 21? Both. It changes with the state and with what you’re playing.
  • Casino age in Las Vegas: 21 everywhere in Nevada, with no exceptions for Poker or sports betting.
  • States with 18 and over casinos: Montana, New Hampshire, Rhode Island, plus tribal casinos in 9 states.
  • Online casino age: 21 in Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island and West Virginia.
  • Sweepstakes casino age: 21 at the biggest brands and at 22 of the 59 sites whose terms I read, and 18 at 36.
  • Lottery age: 18 in 40 states, 19 in Nebraska, and 21 in Arizona, Iowa, Louisiana and Mississippi.

Casino age by state, from each state law and compact

I built this page from the statutes and regulator pages themselves, because most lists copy each other and the mistakes travel with them. Kentucky raised its sports betting age to 21 in July 2026, North Dakota’s tribal casinos are 19, and the biggest sweepstakes casinos now ask for 21. Our US gambling laws guide covers what’s legal where, and this page sticks to how old you have to be.

Casino Age by State: Every State in One Table

Here’s the casino age by state for all 50 states, with the sports betting and lottery ages alongside. Every figure comes from the state’s own statute, rule, compact or regulator page.

How to Read the Table

State-licensed casinos covers commercial casinos, racetrack casinos and card rooms that the state itself licenses. Tribal casinos get their own column because their ages come from a compact between the tribe and the state, and that compact can say something different from state law.

A cell that says No compact means the state isn’t on the Interior Department’s list of 28 states with a tribal gaming compact on file, so there’s no compact age to give. Class II only means the tribe runs Bingo-based games without a compact, so the tribe sets the age itself and it’s worth a call before you travel.

Where a State Has Two Ages

Some states split the age by game. Florida’s racetrack casinos are 21 for Slots but 18 for their Poker rooms, and New York’s commercial casinos are 21 while its video lottery racinos take players at 18. Nebraska lets 19-year-olds play Keno at a racetrack casino as long as it is away from the casino floor. That is why a single casino age by state figure can mislead you.

Gambling Ages by the Numbers

  • 26 states at 21: the number of states whose state-licensed casinos set 21 as the minimum.
  • 7 states at 18: Kentucky, Minnesota, Montana, New Hampshire, Oklahoma, Rhode Island and Washington license a casino-style venue that admits 18-year-olds.
  • 17 states with none: states that have no state-licensed casinos at all, from Alabama to Wyoming.
  • 28 compact states: states where the Interior Department has a tribal gaming compact or procedures on file, which leaves 22 with no compact.
  • 19 in North Dakota: all 5 of the state’s tribal compacts set 19, the one compact age that is neither 18 nor 21.
  • 7 online casino states: every one of them sets 21.
  • 5 sports betting states at 18: Montana, New Hampshire, Rhode Island, Washington and Wyoming, against 33 states at 21, North Dakota at 19 and 11 states where it isn’t legal.
  • 40 lottery states at 18: with Nebraska at 19, 4 states at 21 and 5 states with no lottery.

States Where the Gambling Age Is 18

The states where the gambling age is 18 for casino games fall into two groups, the ones where state law says so and the ones where a tribal compact does. Neither group is long, and neither includes Nevada.

States With 18 and Over Casinos Under State Law

Rhode Island is the clearest case. Both Bally’s casinos admit anyone 18 or older, and that covers the Slots, the Table Games and the sportsbook. Montana sets 18 for every gambling activity in the state, and New Hampshire’s charity casinos are 18 by statute.

The others are narrower. Minnesota’s racetrack card clubs take 18-year-old card players, Washington’s licensed card rooms do the same, and Oklahoma’s racetrack casinos admit anyone old enough to bet on the races, which means 18. Kentucky’s historical horse racing halls, the closest thing the state has to a casino, open at 18 as well. Florida and New York belong on the list for one product each, with Poker rooms at 18 in Florida and video lottery racinos at 18 in New York.

States Where Tribal Casinos Start at 18

Tribal compacts start at 18 in 9 states, which are California, Idaho, Michigan, Minnesota, Montana, New York, Oklahoma, Washington and Wyoming. That is the floor the compact allows, and it is a different thing from the age on the door. Plenty of casinos in those states choose 21, and I’ve listed the ones that publish their age in the tribal section below.

Chart of what you can legally play at 18, 19 and 21 in the United States
What opens at 18, 19 and 21

What Else Opens at 18

Lottery tickets are 18 in 40 states, and sports betting is 18 in 5. Alaska has no casinos, but its charitable gaming has ages of its own, with Bingo at 19 and pull-tabs at 21, and that surprises people who assume the smaller the game, the lower the age.

Why the Casino Age Is 21 in Most States

Most casinos are 21 because of alcohol, and in several states that link is written straight into the law. New Jersey’s casino statute never prints the number. It bars anyone under the age at which a person is authorized to purchase and consume alcoholic beverages, and New York’s commercial casino law uses the same words.

How Alcohol Sets the Age at Tribal Casinos

The same thing happens in tribal compacts. California’s Table Mountain compact sets 18 for the gaming floor and 21 for any area where alcohol may be consumed, which is why a California tribal casino with a bar on the floor is a 21 casino in practice. Washington’s compacts say 18, then 21 as soon as alcohol is offered on the gaming floor, and South Dakota’s say 21 wherever alcohol is sold.

Some tribes have traded the bar for the younger crowd. The Swinomish compact was amended so that players aged 18 to 20 can gamble as long as they do not buy or drink alcohol on the floor, and I think that is the most honest version of the rule you will find anywhere in the country, because it admits the age was never about the Slots in the first place.

States That Raised the Age to 21

The direction of travel is up. Arizona’s compact has required 21 since June 1, 2003, Wisconsin’s Potawatomi compact was amended to replace 18 with 21, and an amendment to North Carolina’s Cherokee compact set 21 for the gaming area. Michigan’s Little Traverse Bay Bands compact goes further and ties its second site to 21 unless the state changes its own casino age. And Kentucky moved sports betting from 18 to 21 on July 15, 2026.

Tribal Casino Ages: The Compact Sets the Floor, the Tribe Sets the Door

Tribal casino ages are set in two steps, first by the compact and then by the tribe, which is why two casinos an hour apart can post different numbers. The National Indian Gaming Commission explains that federal law requires a tribal-state compact for Class III gaming, which is casino gaming with Slots and Table Games, and leaves the regulation of Class II gaming, which means Bingo, pull tabs and certain card games, to the tribes themselves.

Diagram of how a tribal casino age is set, from federal law to the compact to the casino door
How a tribal casino age is set

What the Compacts Say

The compact sets the lowest age the tribe may allow. Tribal casinos are 21 in 18 states, including Arizona, Connecticut, Florida and New Mexico, and the age starts at 18 in 9. North Dakota sits between the two. All 5 of its tribal compacts set 19, with an exception for military personnel carrying military ID.

Oklahoma’s compact doesn’t print a number at all. It borrows the rule for racetrack betting, which bars minors, and Oklahoma law defines a minor as anyone under 18. So WinStar and the Choctaw casinos take players at 18, while River Spirit in Tulsa has chosen 21 for itself.

Tribal Casinos That Publish Their Age

These are the 32 casinos whose own websites state a minimum age. The spread inside a single state is the thing to notice, with Michigan, New York, California, Oklahoma and Washington all showing 18 and 21 side by side.

States With No Compact

Alabama and Texas have tribal casinos but no compact. Their casinos offer Class II games only, so the tribes set the age themselves, and Wind Creek Montgomery, Naskila and Kickapoo Lucky Eagle all post 21. The same goes for tribal casinos in Alaska and Nebraska, where each tribe sets its own age. Bingo is often the exception to a 21 rule, which is how Iowa’s Meskwaki casino, Oregon’s Wildhorse and Wisconsin’s Oneida offer it at 18 inside 21 states.

Online Casino Age: 21 in All 7 Legal States

The online casino age is 21 in every state that has legal online casinos. There are 7 of them, and not one copies the 18 that some of the same states allow on a casino floor or at the lottery counter.

Connecticut 21 Conn. Gen. Stat. 12-863 Department of Consumer Protection

West Virginia 21 W. Va. Code 29-22E-15 West Virginia Lottery

The States Where 18 and 21 Sit Side by Side

Rhode Island is the one to watch. You can walk into a Rhode Island casino at 18 and bet on sports online at 18, but the state’s online casino is 21, and the statute bars anyone under 21 from using an online gaming account for it. Michigan has a split of its own, with tribal casinos that take players at 18 and an online casino law that defines a player as 21 or older.

The apps check it too. New Jersey’s rules make every operator record your acknowledgment that the legal age is 21. Our guides to New Jersey, Pennsylvania and Michigan list the licensed sites in each of those states.

Maine Is Next

Maine’s online casino bill became law without the governor’s signature on January 11, 2026, and it sets 21 as well. Nobody can play yet, and the American Gaming Association lists Maine as legal but not active. The Gambling Control Unit was still writing the rules this fall, with public comments open until October 30, 2026, so the sites haven’t launched.

Sweepstakes Casino Age: 18 or 21, Depending on the Site

The sweepstakes casino age is set by each site’s own terms, and it is 18, 19 or 21 depending on the brand. I read the current terms of 59 sweepstakes casinos, and 22 require 21, 36 accept 18 and 1 sets 19.

The Biggest Names Are 21

You’ll still read that sweepstakes casinos are 18 everywhere. It is not true of the biggest brands. Chumba Casino, Global Poker and Stake.us all require 21, and McLuck, Pulsz, High 5 Casino, Hello Millions and Mega Bonanza do too.

WOW Vegas, Crown Coins Casino, Rolla and Fliff are among the 36 that still accept 18-year-olds, and 4Cx sets 19. Nearly all of these terms add a rider, though. If the age of majority where you live is higher, the higher number applies, and Golden Hearts Games spells out 19 for Alabama and Nebraska.

Your State Matters More Than Your Age

Being old enough doesn’t help if the site doesn’t take players from your state. California made it unlawful to offer online sweepstakes games under Assembly Bill 831, and the brands block other states on top of that. Our sweepstakes casinos hub tracks which states are in and out, and our list of sweepstakes casinos shows the excluded states for each brand.

Sports Betting and Lottery Ages by State

Sports betting is 21 in 33 states, 18 in 5 and 19 in North Dakota. The lottery runs the other way, with 18 as the rule and 21 as the exception. Neither one follows the casino age as closely as you’d expect.

Sports Betting at 18

Montana, New Hampshire, Rhode Island and Wyoming let you bet on sports at 18, and so does Washington, where the only legal sportsbooks are inside tribal casinos. A Washington casino that sets its own floor at 21 can hold its sportsbook to 21 as well.

Kentucky used to be on that list. Its law now tells sportsbooks to keep out anyone under 21, a change that took effect on July 15, 2026, and plenty of lists haven’t caught up. Mississippi and Nebraska only allow sports betting inside casinos, and South Dakota treats it as part of Deadwood gaming, so the casino age decides it there.

Tribal Sportsbooks and the States With None

In New Mexico, North Dakota and Wisconsin the only sportsbooks are at tribal casinos, so the compact age applies. That is 21 in New Mexico and Wisconsin and 19 in North Dakota, where the 2022 compacts added sports betting.

Sports betting isn’t legal in 11 states, which are Alabama, Alaska, California, Georgia, Hawaii, Idaho, Minnesota, Oklahoma, South Carolina, Texas and Utah. Oklahoma came closest to changing that, and its Senate voted a sports betting bill down on April 22, 2026.

Lottery Ages That Aren’t 18

Four states make you wait until 21 for a lottery ticket, and they are Arizona, Iowa, Louisiana and Mississippi. Nebraska sets 19. Alabama, Alaska, Hawaii, Nevada and Utah have no state lottery, and in Nevada and Utah the ban is in the constitution.

A few 18 states carve out exceptions. Massachusetts sells paper tickets at 18 but requires 21 for its online lottery, and Oregon, South Dakota and West Virginia all set 21 for video lottery machines while ordinary tickets stay at 18. Iowa is 21 across the board, racetrack betting included.

What Happens If You Gamble Underage

Underage gambling is a crime under the state laws I read, for the player as well as the casino, and you don’t get to keep what you win. Nevada’s law lists collecting winnings among the things a person under 21 may not do.

What the Player Risks

In Nevada, gambling or loitering under 21 is a misdemeanor. Michigan’s law goes further, with up to 1 year in a county jail or a $10,000 fine for knowingly making a wager under 21. Massachusetts fines an under-21 gambler up to $1,000, and Nebraska treats it as a Class I misdemeanor.

The money goes too. Ohio’s racino rule says an underage play is voidable and the player forfeits all credits, and Oklahoma won’t pay a lottery prize on a ticket bought by someone under 18. So the best case for an underage win is that you never see it.

What the Casino Risks

Casinos are on the hook as well, which is why the ID checks are strict. Nevada law says a casino can’t defend itself by claiming it believed the person was 21. In Pennsylvania, the Gaming Control Board fined a casino $10,000 after staff let an 18-year-old onto the floor, where he gambled at a table.

That’s the reason you still get carded well past 21. Bring a government photo ID every time, and don’t take a younger friend along hoping the door staff won’t look, because the fine lands on the casino and it knows that.

If You’re Under the Legal Age

If you’re under the legal age in your state, the answer is to wait. Offshore sites that advertise to 18-year-olds aren’t licensed in any US state, and you’d have no regulator to turn to when a payout goes missing. Our Responsible Gambling guide covers limits, self-exclusion and the warning signs, and the US online casinos guide shows what’s licensed in each state.

Frequently Asked Questions

What is the casino age in Las Vegas?
Toggle answer

The casino age in Las Vegas is 21. Nevada law bars anyone under 21 from playing, placing a wager, collecting winnings or loitering in a gaming area, and that covers sportsbooks and Poker rooms too. Under-21s can walk through a casino but can’t stop at the games.

Which states have a gambling age of 18?
Toggle answer

Montana, New Hampshire and Rhode Island let you play casino games at 18 under state law, and Kentucky, Minnesota and Washington license racing halls or card rooms at 18. Tribal compacts also start at 18 in 9 states, including California, Michigan, Oklahoma and Washington.

How old do you have to be to gamble online?
Toggle answer

You must be 21 to play at a legal online casino in all 7 states that have them, which are Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island and West Virginia. Online sports betting is 21 in most states and 18 in a few, including New Hampshire and Wyoming.

Can you go into a casino if you are under 21?
Toggle answer

In most states you can pass through but you can’t stay on the gaming floor. Nevada bans loitering in gaming areas under 21, and casinos like Wynn Las Vegas let under-21s walk through only. Restaurants, hotels and shows off the floor are open to younger guests.

What is the gambling age at tribal casinos?
Toggle answer

It’s 18, 19 or 21, depending on the tribe’s compact with the state and then on the casino itself. Tribal casinos are 21 in 18 states and start at 18 in 9, and all 5 North Dakota compacts say 19. Many casinos in 18 states still choose 21.

How old do you have to be to play at a sweepstakes casino?
Toggle answer

It depends on the site. The biggest brands, including Chumba Casino, Global Poker, Stake.us, McLuck, Pulsz and High 5 Casino, require 21, while WOW Vegas, Crown Coins Casino and many smaller sites accept players at 18. Your state also has to be one the site serves.

Why is the gambling age 21 in most states?
Toggle answer

Mostly because casinos serve alcohol. New Jersey and New York tie their casino age to the legal drinking age in the statute itself, and tribal compacts in California, Washington and South Dakota switch from 18 to 21 wherever alcohol is served on the gaming floor.

Is the lottery age 18 in every state?
Toggle answer

No. The lottery age is 18 in 40 states, but Nebraska sets 19, and Arizona, Iowa, Louisiana and Mississippi set 21. Alabama, Alaska, Hawaii, Nevada and Utah have no state lottery, and Massachusetts requires 21 for its online lottery.
