Is Gambling Legal in Florida?
Last reviewed: 28 July 2026. Next scheduled review: 26 October 2026.
Florida Gambling Laws allow legal online sports betting but not real-money online casino play. Sports wagering has run under the Florida Gaming Control Commission since December 2023.
Online slots, table games, and poker for cash are still off the table here. This guide covers what’s legal, what isn’t, any pending bills, the age rules, and where Florida players actually stand. Where a product isn’t legal, we say so plainly, and we don’t point you to an offshore workaround.

Online Gambling Laws in Florida
Florida Gambling Laws allow legal online sports betting but not real-money online casino play. Like most of the country, Florida treats each online product on its own, so the honest answer depends on which one you mean.
Online sports betting is legal and regulated by the Florida Gaming Control Commission. Online casino games, meaning real-money slots and table games, are not legal, and neither is online poker. You’ll see offshore sites advertise to Florida players anyway. They hold no license and no consumer protection here, so skip them.
Florida Online Sports Betting
Florida sports betting works unlike almost anywhere else. It runs through the Seminole Tribe under a state compact signed in 2021 and upheld in the courts, and Hard Rock Bet, the Seminole’s platform, is the only legal online sportsbook in the state. That exclusivity runs through 2051.

How it works
You have to be 21 and physically inside Florida to bet, and every mobile wager is routed through servers on Seminole tribal land, which is the legal mechanism that makes statewide betting work. A 2026 effort to open the market to other operators failed, so Hard Rock Bet stands alone. The Florida Gaming Control Commission oversees gaming in the state.
Online Casino in Florida: The Real Status
No. Real-money online casino is not legal in Florida. Casino games are tied to the Seminole compact and played in person at tribal properties, and there’s no legal online casino for statewide play.
Where that leaves you
If you want to play real-money online casino today, the nearest legal option is a state where it’s regulated. Online casino is live in New Jersey and Pennsylvania, but you have to be physically inside those states to play, not just a resident. For the full national picture, see our US online gambling laws guide.
Online Poker in Florida
Legal online poker doesn’t exist in Florida. It travels with online casino in almost every place that has it, so if a future law passes, real-money poker would arrive alongside slots and tables. For now, any legal poker is live, in person.
Casinos and Land-Based Gaming in Florida
Florida’s casino scene is anchored by the Seminole Tribe’s Hard Rock properties and other tribal casinos, along with pari-mutuel venues offering cards and slots in some counties. These are in-person venues under the tribal compact and state law, and they’re where the casino games you can’t play online for cash actually happen.

Daily Fantasy Sports and the Lottery
Daily fantasy sports is legal in Florida, so DraftKings and FanDuel contests run without trouble. The lottery is legal too and sells draw games, with online options in many places. Neither counts as online casino play, and both sit under their own rules.
Sweepstakes and Social Casinos in Florida
Sweepstakes casinos, the gold-coin and sweeps-coin sites that try to sidestep gambling law, sit in a grey zone that’s shrinking fast. Regulators across the country have started warning against them and moving to ban the model. Treat any sweeps or social casino in Florida as legally shaky, and never as a stand-in for a licensed real-money casino.
Legal Age, Responsible Gambling, and Getting Help
You must be 21 to bet on sports in Florida. Every legal sportsbook offers deposit limits, time-outs, and self-exclusion, and there’s a self-exclusion list you can join across licensed operators.
If gambling stops being fun, help is free and confidential. Reach the Florida problem gambling line at 1-888-236-4848, or the national helpline any time at 1-800-522-4700. You don’t have to be in crisis to call, and reaching out early is easier than most people expect.
Tax on Gambling Winnings in Florida
Gambling winnings are taxable in Florida by both the IRS and, where one applies, the local income tax. Sportsbooks issue a federal Form W-2G once a payout crosses the reporting threshold, but you owe tax on winnings whether or not you get the form. Keep your own record of wins and losses, because if the numbers are ever questioned, the burden of proof sits with you.
Florida Gambling Laws: FAQ
Is online casino legal in Florida?
No. Real-money online slots and table games are not legal in Florida. Any site offering cash casino games to Florida players today is offshore and unlicensed.
Can I bet on sports online in Florida?
Yes. Online sports betting has been legal since December 2023, regulated by the Florida Gaming Control Commission. You must be 21 and physically inside Florida to bet.
Which sportsbooks are legal in Florida?
Just one. Under the Seminole Tribe’s state compact, Hard Rock Bet is the only legal online sportsbook in Florida, and it will stay that way through 2051. A 2026 push to add competitors failed. Any other betting site advertising to Floridians is offshore and unlicensed.
Are sweepstakes casinos legal in Florida?
Sweepstakes casinos, the gold-coin and sweeps-coin sites that try to sidestep gambling law, sit in a grey zone that’s shrinking fast. Regulators across the country have started warning against them and moving to ban the model. Treat any sweeps or social casino in Florida as legally shaky, and never as a stand-in for a licensed real-money casino.
What is the legal gambling age in Florida?
You must be 21 to bet on sports in Florida. Operators verify your age and identity at signup, and underage accounts are closed.
Will Florida legalize online casino?
Unlikely. Florida’s gambling is locked into the Seminole compact through 2051, and there’s no path to a competitive online casino market outside it. Don’t expect statewide iGaming.
Can I use an offshore online casino from Florida?
You can reach these sites, but they carry no Florida license and no consumer protection. A withheld withdrawal leaves you with little recourse, and there’s no self-exclusion tie-in. If you want a legal online casino, play in a state where it’s regulated, such as New Jersey, while physically there.
Do I have to live in Florida to bet?
No. You need to be physically inside Florida when you place a bet, not a resident. Sportsbooks use location checks to confirm where you are, and residency has nothing to do with it.
