New York gambling laws let you bet on sports from your phone but not play real-money online casino games. The state runs one of the biggest legal sports betting markets in the country, and it treats each online product separately, so a plain yes-or-no answer depends on which one you mean.

Online sports betting is legal and live, regulated by the New York State Gaming Commission since January 2022. Online casino games, meaning real-money slots and table games, are not legal here, and neither is online poker. Lawmakers keep filing bills to change that, but nothing has passed. The short version: bet on sports legally, skip any site that offers you online slots for cash, because it isn’t licensed in New York.

New York launched mobile sports betting in January 2022 and it became the busiest market in the US almost overnight. The New York State Gaming Commission licenses the operators, and you have to be physically inside state lines and at least 21 to place a bet.

The operators

The state authorized nine mobile sportsbooks. Eight are live after one shut down, and the group includes the names most bettors already know, such as DraftKings, FanDuel, BetMGM, Caesars, and BetRivers. Location checks confirm you’re in New York every time you log in, so a VPN won’t get an out-of-state account onto the app.

The 51% tax and what it means for you

New York taxes online sports betting at 51% of operator revenue, the highest rate in the country. That number matters to players because operators pass some of it on. Promotions here are thinner than in lower-tax states, and pricing on some markets is a touch worse. A pending bill would lower the rate if the state adds more operators, dropping it in steps as the number of books rises, but that’s a proposal, not law.

There is no legal real-money online casino in New York. You cannot play licensed online slots, blackjack, or roulette for cash inside the state, full stop. Any site telling you otherwise is offshore and operates with no license or consumer protection in New York.

The 2026 bills

Senator Joseph Addabbo and Assemblywoman Carrie Woerner have pushed parallel bills to authorize online casino play, with a proposed 30.5% tax on gross gaming revenue. The plan would cover digital slots, table games, live dealer, and online poker, and it would let existing casinos, tribal operators, and current sports betting licensees apply. Analysts still see a 2026 launch as unlikely, with tax and license-count fights holding it up.

Where that leaves you

If you want to play real-money online casino today, the nearest legal option is across the border. Online casino is live and regulated in New Jersey and Pennsylvania, but you have to be physically in those states to play, not just a resident. Legal online poker doesn’t exist in New York yet. It’s bundled into the same online casino bills, so if those pass, real-money poker would arrive with slots and table games under the 30.5% framework. Until then, the only legal poker in the state is live, at the upstate commercial casinos and tribal rooms.

New York has a full land-based scene even without online casino. Four commercial casinos operate upstate, alongside tribal casinos run by the Seneca, Oneida, and Saint Regis Mohawk nations under federal compacts, plus racinos with video lottery terminals at tracks like Resorts World and Empire City.

The state is also awarding up to three new downstate casino licenses covering the New York City area, a process worth billions that has drawn bids from major operators. Those are brick-and-mortar licenses, not online ones, so they won’t bring internet casino play on their own.

Daily fantasy sports is legal and regulated by the Gaming Commission, so DraftKings and FanDuel DFS contests run legally statewide. The New York Lottery is one of the oldest and largest in the country, and it sells draw games and subscriptions online, though most instant play still happens at retail.

Sweepstakes casinos, the sites that use gold coins and redeemable sweeps coins to sidestep gambling law, operate in a grey zone that’s shrinking fast. New York regulators and lawmakers have taken a hard line, with the Gaming Commission warning on unlicensed sweeps and prediction products and legislators pushing to ban the model outright. Treat any sweeps or social casino as legally shaky in New York, and never as a real-money casino substitute.
