Virginia Gambling Laws allow legal online sports betting but not real-money online casino play. Like most of the country, Virginia treats each online product on its own, so the honest answer depends on which one you mean.

Online sports betting is legal and regulated by the Virginia Lottery. Online casino games, meaning real-money slots and table games, are not legal, and neither is online poker. The operators

Virginia runs a competitive market with more than a dozen licensed mobile sportsbooks, including the national names most bettors know, such as DraftKings, FanDuel, BetMGM, and Caesars. A location check confirms you’re inside state lines each time you log in, so an out-of-state account won’t get onto the app through a VPN.

Tax and what it means for you

Virginia taxes sports betting at 15% of revenue, with a share going to a problem gambling fund. That figure is paid by the operators, not by you on your bets, but it shapes how generous promotions are and how sharp the pricing gets. Higher-tax states tend to run leaner bonuses, and that trickles down to the value you see in the app.

Not yet, but it came close in 2026. Companion bills, House Bill 161 and Senate Bill 118, each passed their own chamber and proposed a 20% tax with the Virginia Lottery Board as regulator, but lawmakers could not agree on a single version before the session ended. The push is expected to return, so watch this one.

Where that leaves you

If you want to play real-money online casino today, the nearest legal option is a state where it’s regulated. Online casino is live in New Jersey and Pennsylvania, but you have to be physically inside those states to play, not just a resident. Legal online poker doesn’t exist in Virginia. It travels with online casino in almost every state, so if a future iGaming law passes, real-money poker would arrive alongside slots and tables. For now, the only legal poker is live, at the state’s casino rooms.

Virginia has a real land-based scene even without online casino. The state is home to three land-based casinos now open in Bristol, Danville, and Portsmouth, with more in development. Neither of these counts as online casino play, and both sit under their own rules.

Sweepstakes casinos, the gold-coin and sweeps-coin sites that try to sidestep gambling law, operate in a grey zone that’s shrinking fast. Regulators and lawmakers across the country have started warning against them and moving to ban the model. Treat any sweeps or social casino in Virginia as legally shaky, and never as a stand-in for a licensed real-money casino.
