The three casinos split gaming revenue with the state, the vendor and the horse-racing purses the racino model was built to fund. That purse funding is why Delaware ties online gaming to racetracks in the first place, a structure rooted in the 1990s video lottery law.

Delaware legalized real-money online casinos through the Gaming Competitiveness Act of 2012 (House Bill 333), which authorized the Delaware Lottery to run internet casino games, poker and, later, sports wagering. Online casino play went live in November 2013, making Delaware one of the first three states, alongside Nevada and New Jersey, to offer regulated iGaming.

What sets Delaware apart is that this isn’t an open market. Every legal online casino operates under the Delaware Lottery, and the platform is tied to the state’s three land-based casinos: Bally’s Dover (formerly Dover Downs), Delaware Park and Harrington Raceway. There’s no separate licensing route for outside operators to enter independently, so residents don’t choose between a dozen competing apps the way players do in New Jersey or Michigan.

When I test a market like this, the key legal point is simple. The only casino that’s licensed and legal in Delaware is the state platform. Offshore sites and crypto casinos that accept Delaware players aren’t regulated here, carry no state consumer protections, and fall outside the Lottery’s oversight. Delaware has a long place in US sports betting history. It was the first state to launch single-game wagering after the federal PASPA ban fell, taking retail bets in June 2018. For years, though, sports betting was retail only, limited to the three casinos and lottery parlay tickets, with no statewide mobile app.

That changed with the Rush Street deal. Statewide mobile sports betting launched via BetRivers on December 27, 2023, giving Delaware its first legal online sportsbook. Anyone 21 or older who is physically located inside state lines can bet on pro and college sports from a phone or computer.

BetRivers is the only legal online sportsbook in Delaware, and the state uses a revenue-sharing model that directs roughly half of sports betting proceeds to the state, with the remainder split among the casinos, the vendor and horse racing purses.

For a bettor, the practical shape is familiar Rush Street territory. You get pre-match and live betting across the major leagues, standard markets like moneylines, spreads, totals, props and parlays, plus same-game parlays and a rewards program that ties into casino play on the shared wallet. The high revenue share to the state does mean the odds and promos are less aggressive than what you would see from competing books in an open market, which is the same trade-off that shapes the casino side.

Online poker was legalized alongside casino games in 2012 and has always run through the Lottery. For most of the first decade it operated on the 888 network and shared player pools with Nevada, and later New Jersey, through the Multi-State Internet Gaming Agreement (MSIGA). Delaware was a founding MSIGA signatory, which is what kept a small state’s poker tables busy enough to be viable.

When 888’s contract lapsed at the end of 2023, Delaware went into a poker blackout with no legal online room for well over a year. The market returned on June 10, 2025, when BetRivers Poker launched simultaneously in Delaware, Michigan and West Virginia, joining Pennsylvania on the same shared-liquidity network.

That four-state pool is why the relaunch mattered so much. Delaware poker revenue doubled by October 2025 and tripled by November, according to Lottery figures. The minimum age for online poker is 21, and, as with casino and sports betting, only the state-run BetRivers Poker room is legal here.

Every account goes through identity verification. When you register, the platform confirms your name, date of birth and identity, using the last four digits of your Social Security number and, if needed, a copy of a government ID. This is standard know-your-customer checking and it protects both the operator and the player.

Delaware also enforces a geolocation requirement. You must be physically inside state lines to place a real-money bet, and the software checks your location on each session. A Delaware address alone is not enough. If you travel out of state, legal play pauses until you return, though the MSIGA poker pool lets Delaware accounts share tables with players in partner states.

Gambling winnings are taxable in Delaware. They count as income at both the federal and state level, so money won on the state casino, poker or sportsbook can be subject to Delaware income tax, which runs on a graduated scale up to 6.6 percent, on top of federal tax.

For larger prizes, the operator may issue an IRS Form W-2G and withhold tax before you are paid, particularly on qualifying jackpots or high-odds wins. Smaller wins are still reportable even when no form is issued, and the responsibility to report sits with the player.

If a site claims to be a Delaware online casino and it’s not the Rush Street Interactive platform running under the Delaware Park, Harrington or Bally’s Dover brands, it is offshore and unregulated.
